Under the US immigration law, there are various categories of the family-based immigration process. This depends on your relationship to the person you are sponsoring, their marital status and age. NON IMMIGRANT FAMILY BASED VISAS

K1 Fiancé Visa for fiance of a U.S Citizen.

The K1 fiance visa is for the fiance of a U.S citizen outside the U.S who wants to come to the U.S to get married and thereafter seek lawful permanent resident status ( green card) through adjustment of status  in the U.S

The U.S Citizen and foreign fiance must have met in person within the last two years unless exempted from the requirement to have met in person within the two years time frame.

They must also be legally free to get married and such marriage must take place within 90days of the fiance’s arrival in the U.S on a k1 visa. Any eligible  k1 dependent child is eligible for a K2 visa classification and adjustment of status for green card in the U.S.

K3 Spousal Visas for Spouse of a U.S Citizen.

The K-3 nonimmigrant visa is for the foreign spouse of a United States (U.S.) citizen for whom an immigrant visa petition (Form I-130 ) has already been filed and its pending with the U.S Citizenship & Immigration services.

This non immigrant visa category is intended to shorten the physical separation between the foreign Spouse and U.S. citizen spouse by having the option to obtain a temporary nonimmigrant K-3 visa at a U.S embassy or consulate while the immigrant visa petition is pending.

With a K3 visa, such foreign spouse is able to enter the United States to await approval of the immigrant visa petition ( Form I-130) and subsequently apply to adjust status to a permanent resident ( green card)  upon approval of the petition.

Under the U.S. immigration law, a foreign citizen who marries a U.S. citizen outside the U.S. must apply for the K-3 visa in the country where the marriage took place..

Any eligible  k3 dependent child is eligible for a K4 visa classification and adjustment of status for green card in the U.S.

When the K3 visa  and immigrant visa petitions ( form I-130 ) are approved by USCIS  at the same time, or if  USCIS approves the I-130 before the K3 visa petition, the utility of the nonimmigrant K-3 visa ends.
