EB-1A: Persons of Extraordinary Ability
The EB-1A visa is for individuals who can demonstrate extraordinary ability in the sciences, arts, education, business, or athletics. To qualify, the person must show sustained national or international acclaim and that their achievements have been recognized in their field. Evidence of a one-time major achievement, such as a Pulitzer Prize, Olympic medal, or Nobel Prize, can satisfy this requirement. Alternatively, the applicant can provide documentation meeting at least three out of ten criteria defined by USCIS. These criteria include proof of awards or prizes, membership in associations requiring outstanding accomplishments, published material about the individual, original contributions of significance in the field, authorship of scholarly articles, artistic exhibitions or showcases, high salary relative to others, and other markers of excellence and distinction.

A key advantage of the EB-1A is that it does not require a job offer or employer sponsorship. Candidates can self-petition by submitting the EB-1A application to USCIS on their own behalf. This means you do not need a U.S. employer to sponsor you for EB-1A if you qualify as a person of extraordinary ability. However, you must demonstrate intent to continue working in your field of expertise in the United States. Due to its high evidentiary standards, EB-1A is generally reserved for top leaders in their fields—such as internationally acclaimed artists, renowned researchers, world-class athletes, or high-profile business innovators. The reward for meeting these strict requirements is a fast track to permanent residence without many of the hurdles faced by other visa categories.
